Service & Usage Agreement (Terms of Service)

Ferkesh Hosting (Ferkesh)

This Agreement outlines the terms under which you (“User”) may use any hosting or related services provided by Ferkesh Hosting, operated by Ferkesh. By using our services, you agree to all terms below.

1. Eligibility & Account Requirements

1.1 You must be at least 18 years old.
1.2 You agree to provide accurate account information.
1.3 You are responsible for maintaining account security.
1.4 All activity under your account is your responsibility.

2. HIPAA Disclaimer

Ferkesh Hosting does not comply with HIPAA standards and must not be used for storing protected health information (PHI).

3. Service Terms, Renewal & Cancellation

3.1 Services are billed in advance for the selected term.
3.2 Services automatically renew unless you disable auto-renew.
3.3 You may cancel anytime through your portal.
3.4 Upon cancellation, all data may be permanently removed.

4. Refund Policy

4.1 Hosting plans include a 30-day money-back guarantee.
4.2 Domain registration fees are non-refundable.
4.3 If your plan included a free domain, a $20 domain fee applies if you request a refund and keep the domain.
4.4 No refunds are provided for accounts terminated due to policy violations.

5. Billing & Payments

5.1 Payment is required before service activation.
5.2 Unpaid accounts may be suspended or terminated.
5.3 Chargebacks result in immediate suspension.
5.4 Billing disputes must be opened within 90 days.

6. Acceptable Use Policy (AUP)

You agree not to use Ferkesh Hosting for:

  • Illegal activities

  • Sending spam or mass unsolicited email

  • Hosting malware, phishing, or harmful content

  • Storing copyrighted material without rights

  • Abusing server resources

  • Running services that disrupt other users

7. Resource Usage

7.1 Users must maintain responsible resource usage.
7.2 Excessive CPU, RAM, or I/O usage may require:

  • a plan upgrade

  • resource limits

  • temporary suspension

7.3 Hosting accounts cannot be used for:

  • file warehousing

  • cloud backups

  • media storage not related to your website

7.4 Inode and database limits apply depending on your plan.

8. Domains

8.1 Domain registrations follow ICANN rules.
8.2 Domain renewal is the user’s responsibility.
8.3 Expired domains may incur recovery/restore fees.

9. Support

9.1 Support is provided via ticket system only.
9.2 Verification is required for account safety.
9.3 Support covers hosting issues, not custom code or 3rd-party software.

10. Data Backups & Loss

10.1 We provide backups depending on your plan.
10.2 Backups are not guaranteed.
10.3 Users must keep their own backup copies.
10.4 Ferkesh Hosting is not liable for data loss.

11. Liability Limitations

To the maximum extent allowed by law:

  • Ferkesh Hosting is not responsible for indirect or consequential damages

  • Total liability is limited to the fees paid in the previous 90 days

12. Suspension & Termination

We may suspend or terminate accounts for:

  • Policy violations

  • Abuse

  • Non-payment

  • Security threats

  • Harassment toward staff

  • Fraudulent activity

13. Governing Law

This Agreement is governed by the laws of the United States.
If required by your local consumer laws, local protections also apply.

14. Changes to This Agreement

Ferkesh Hosting may modify this Agreement at any time. Updates will be posted on our website. Continued use of our services indicates acceptance of the changes.
